The UPA is not exclusive and allows the casting of unionized and non-unionized actors and non-professional actors. It also means that Union performers have the right to pursue another profession during the production of a particular project. However, contracts are still required and must be made available for performance no later than the first working day by the performer on the project. If the performer does not receive the contract before the end of his or her first day of employment, he or she is entitled to a lump sum damages of $10.00 per day until the performer receives the fully performed employment contract. If the project signatory does not submit the employment contracts to SAG-AFTRA, the union is entitled to charge an additional fee of $10.00 per day per contract until the employment contracts are concluded. The saying goes, “If you think it`s expensive to hire a professional, wait until you hire an amatuer.” It can be intimidating to sift through all the fees and rates required by SAG-AFTRA, but ultimately, when you have your creative project in the hands of a professional talent, you get the greatest return on investment. All performers who have been hired or upgraded under a principal performer contract whose performance remains in the final product are entitled to arrears.
Background actors do not receive residues and are not entitled to them unless they are promoted to lead actors. For SAG-AFTRA underlying players, this can be difficult as the contract only applies in certain areas, as mentioned above. Producers and underground players should be particularly vigilant when filling or accepting employment, as both could run the risk of breaching the contract by providing and accepting uncovered work. Today, almost a hundred years later, SAG-AFTRA still strives to organize all the work done under its jurisdiction, negotiate the best wages, working conditions, health and pension benefits, create employment opportunities, enforce contracts and protect SAG-AFTRA members from unauthorized use of their work. However, the work of the Union is not possible without the cooperation of those within the sector who are not part of the union – mainly studios and production companies.
